WARRANTY

Seller warrants that at the time of shipment the products sold hereunder are free from defects in material and workmanship, and will conform to seller’s applicable specifications. This product has a limited one year warranty, as follows. If any defect within this warranty appears, Buyer shall notify Seller immediately. Seller agrees, at its sole election, to repair, replace, or issue a credit in the amount of the unit contract price for any goods which, within one year from date of shipment by Seller, shall, upon test and examination by Seller, prove defective within the above warranty. No product will be accepted for return or replacement without prior written authorization of Seller. Upon such authorization, the product may be returned with shipping charges prepaid by Buyer.

The warranty does not cover any damage due to accident, misuse, negligence, abnormal use, or any product which has in any way been altered by anyone, other than an authorized representative of Seller.

The above warranties are given in lieu of all other warranties, express or implied, including warranties of merchant- ability and fitness of particular purpose or use. The remedies of Buyer shall be limited to those provided herein to the exclusion of all other remedies including, without limitation, incidental, special, indirect or consequential damages. In no event shall Seller’s liability for claim exceed the price of the product which gives rise to the claim.
